Hi,

I am working in NJ on H1 since Feb06, and my wife and kid came over from India in July06.

I need to file both the Federal and NJ State tax return, which I'd be filing jointly.

Questions:

Can I file NJ return without ITINs for my wife and kid?

Which for shall I use to fill NJ state return?

Mr. Ingh:

File the federal return with W-7 and notarized passport; there have been multiple postings by me explaining the process.

Hold off on filing NJ state return until you get the ITIN back.

If you are getting a refund, filing late has NO penalties since no tax is owed.

If you OWE taxes, file for an extension and mail amcheck to cover what you owe.
