Good evening, My child's father has a probation violation hearing next week. He was violated for leaving the state
without permission. I was in atlantic city and was intoxicated and asked
him to come get me. When he came, I remember telling him I couldn't
breathe and he called the front desk asking for help. I just wanted to
be taken home, so I remember him restraining me from leaving and I was
trying to fight back and got upset and called the police. The ambulance
had came and they asked if I wanted to be taken to the hospital I
declined however the cops took him In for simple assault (which will be
dropped November 12th). He is already on probation for 5 years and
already completed 3. He's stayed out of trouble, worked, (but is
currently unemployed and looking) and doesn't do drugs. Is the judge
willing to hear me out since it wasn't his fault for leaving the state?

If he has a lawyer at the hearing, then the judge should have to hear you out. That will cover the assault issue. But he left the state, there is no reason good enough, he should have callled a friend to do it. Had you stay there till sober.
