My husband got arrested last week for a parole violation. He ran passed his discharge date. Has no new charges and waived his right to the hearing. His discharge date was march of this year. He is currently sitting in county jail. He seen the po and he told my husband 2-14 days he will know an answer. Does anyone know what will or may happen. Has anyone on here gone through this also? Thank you ahead of time.

Hello p:

Couple things... If what you say is accurate, your husband should be out of jail NOW for TWO reasons... A criminal sentences CANNOT be extended for ANY reason, and if he's been in jail for 6 months without any charges or trial or hearing of any sort, then his rights are being violated. He clearly doesn't HAVE an attorney because an attorney would never let this happen. You need to hire one TODAY.

Or, in the alternative, you don't really have all the facts. That sounds to me like the case.. I'm here to help if I knew EXACTLY what's going on.

Hello E,
He has only been in county jail for a week. And yes all my facts are accurate. The county sheriffs, dps, and us marshals came to our home. They arrested him and the 2nd day in county po came. I'm not really understanding the whole situation. He does not have new charges and pretty much ran for a year. I'm trying to understand all this but I'm confused. I just want him home. If he hasn't caught any new charges they should release him right? Would they put him back on parole or ket him out once po has come back with answer. The parole board said 2-14 days he will know an answer. Please if you know what may or will happen let me know.

Hello again, p:

He ran passed his discharge date. I didn't understand that he absconded. In that case, his time STOPPED when he left, and he'll, at least, have to serve that much time in prison. No, they're NOT gonna to let him go. You can't run away and expect NOTHING to happen.

We don't do email.
