You file divorce from the country you are currently a legal resident of. Where ever that might be.

Maybe the language barrier was the problem.

As Smoothy wrote, you can file for divorce in the Philippines, assuming that the child is there too.

If you need to litigate custody of the child in Canada or, if there are Canadian assets of which you want a share, contact an attorney in the part of Canada where your husband resides, and where the property is. The attorney will guide you from that point. It may not be necessary to actually travel.

We do not refer lawyers on this site, that goes against what we do here. Finding a lawyer is something you'll have to do on your own. Finding someone a lawyer is a lot to ask from a volunteer, which is what we all are.

So you're the husband, you moved back to the Philippines 5 years ago, when you separated? Is that right?

Are you saying that the law in the Philippines forbids you from getting a divorce? If that's the case, I have to ask how you think you're going to achieve this while living in the Philippines.

I'm sorry.. I just want to find a lawyer that can help me I don't have any relatives in Canada that could help me.
Yes I'm the husband and yes I move back here in the Philippines 5 years ago.

In the Philippines divorce is not legal. In Canada it's legal and I also saw the grounds for divorce which is 1 year separation.. I guess 5 years separation is enough to file divorce in Canada.. Which divorce is legalize. Thank u so much for your replies
