View Full Version : If the courts take your nephew can I as the aunt adopt him?

My nephews dad shook him when he was 4 months old. MY SISTER WAS PLED NOT GUILTY! She was pregnant to another man when they told her that she had to sign her rights away or they would take both of them. Including my unborn nephew. It's a closed adoption but we just found out the other day that he isn't adopted out yet. I need to know if there is anyway possible that I can get my nephew back. Mind you we fought for him for 3 years and neither of his parents are drug addicts.

I'm trying to understand. Your brother in law shook the child and he, as well as your sister, were taken to court and lost custody. Is that right so far?

Doesn't matter that they aren't drug addicts, it's been proven that they are a danger to the health and safety of the child.

This is a global website, so your location is important.

In some locations, it is a no go for family members to adopt or foster the children of family members because there is a risk of repeated abuse, particularly of this kind.

If you lost previously, I doubt if you can win now. However, I think there are parts missing to this story. For Family Services to force her to give the child up for adoption would mean they though she was a danger to the child. But based on what you said, that should apply to any child she has. Why would this one be different?

For them to not give the child to a family member who has indicated willingness to take the child, indicates they don't want any chance that the parents would have access to this child. Again, a drastic step.
