View Full Version : Back child support being taking out of my dads account (va benefits) after death

Well my question is:
My father passed away 09/07/13 and he lives in Iowa he has been receiving va benefits service connected disabilty for years. He has money in this bank account currently but is frozen. I received a letter form State of Arizona stating they had an order to take $325.00 out of his account on 09/3 4 days before he passed away and sent copy of check. They did this to my father 6 months ago and he fought it because they are not allowed by law to garnish money from va benefits. And he got his money back . Will the state of Arizona take more money out of this account for that after he has passed ? I'm worried because if I do not get that money I can not pay the expenses for this funeral . Who do I contact? Please help?

He lived in Iowa, but the State of Arizona is trying to get VA benefits payable to your father? They have, I assume, requested the VA to pay the benefits to them, correct?

Contact the VA and the official from Arizona who sent the letter.

How do you propose to cash, when and if you received it, this check payable to your late father? I believe the VA may also pay death benefits. Find out about that too.

It was a order from the state of Arizona sent to the bank in Iowa and they took it out of the money that was in their. He still has money in their, I signed an affadavit and after 40-days and after I send them the death certificate they can only release funds to me and then ill pay the funeral home.
