View Full Version : Can a probation Officer threaten to take a child and put in foster care?

My 13 year old son got in some trouble recently the probation officer keeps threatening me to take both my children because of him getting in trouble he told my ex-husband that he will not let my son come home with me and he was going to put both my kids in foster care if my ex-husband didn't fight me for custody I have never heard of him doing anything like this to anyone else that's kids have got in trouble and he is telling people about what is going on with my son in court isn't that illegal for him to do that because he is a Juvenile? I live in Indiana

He can do that, particularly if its true... being under age is no shield... in fact they could call child protective services on you... what happens then is up to CPS. So yeah.. if they find cause... it could happen. But the Probation officer won't be who decides.
Incidentally... its not normal or common for kids of any age to be getting in trouble with the police all the time.

Yes, probation officers will threaten often. But this is a threat he can do, if there is a reason for it. He can revoke the probation and have child back before the court, if he feels the home life is not suitable for child. To take other child he has to get children's services or CPS involved.
But they normally work close together.
Is there some reason, he is not getting along with family ?

He isn't in trouble all the time it was a incident and my other one is 17 has straight a's and hasn't been there is no reason for the probation officer to act the way he has been towards me he told my son before that he gets paid no matter if he has to see kids or not he would rather not have to deal with them the is no problem at home my son told him to I have did about everything I could he chose to do what he got in trouble for he wasn't at home when it happened he was at school I hired a attorney because of the harassment because it has not been warranted my son hasn't been in trouble a lot he has always had good grades and done well in school he just made a mistake
