View Full Version : Please Help: I live in Arkansas and I really need some answers.

First of all I got custody of my 5 year old daughter and my 6 year old daughter July 2012. I have now had custody of them for a year now. I am dating a convicted felon who spent 20 years in prison for killing a guy. We are thinking about getting married and then moving in together. He is a great guy and is good with my kids. He is not a bad person. I do not want to loose custody of my girls and he feels the same way.

The father stands a really good chance based on this guys history... fact is great guys make it to old age without sending a huge chunk of it in prison for murder.

Maybe he really changed... maybe he didn't... only he knows for certain.

And Family court will think that too. Considering the percentage of people who commit further crimes. Their primary concern will be what's best for the child...

I have already been to court. The judge gave me custody of the girls and gave their father every other weekend at his house. The judge said it was for the girls best interested when we went to court. Because the father would send them to school and my house nasty and he is abussive to women. He is a two time felony for endagering a minor and being a felon with fire arms, and abuse. Was accused of raping a 12 year old child with problems, which was dropped. His girlfriend is a felon out of prison as well.

If the father gets them weekends how is he sending them to school? And does that mean you don't send them to school regularly? Is your house nasty or is that what he told the Judge?

No my home is clean. I got my divorce in 2012 and got joint custody of the girls. My husband did not like it. He said to me that they had a new mommy and he was taking me back to court. So we went back to court in 2013 and I got full custody of my babies. They go to school every week day. He was sending them to school dirty when he had joint custody. I do not think you understand.

The father of my girls kept turning me in to the DHS. I got turned in a bunch. Like one time they came out because he told them I would drink coffee all day and pass out on it. Which was really crazy!

The way you worded it I was not sure if it was your ex or the Judge claiming that or if it was that way.

Oh sorry about that. No my home is clean :) the girls would be dirty when they are with him and his girl friend. Do you understand about the school stuff and everything else now.

I know what you was talking about. I did say my house was dirty. But I did not mean that. Guess I worded it wrong. :(

The court does go by the best interest of the child but since you now have full custody it doesn't seem like your ex's say will have much weight with the Judge. Also I would think that as long as your fiance's crime was not against any child that will be taken into consideration.
Not knowing the circumstance of his killing a guy its rather hard to say though.

He got into a knife fight with a guy who started the fight with him first. He was trying to protect his self. So the guy died.

If there is a problem the court should take all that into consideration as well as that he has done 20 years. Its hard to understand how someone can kill someone cold blooded murder and get 7 years while someone else gets 20 for a fight that turned into self defense. I think your best defense is to be proactive and ask someone in your state government what can happen in your situation. Also Excon, an expert on this site will probably be able to answer you better, so keep coming back until you get a reply from him.
