Ok got validation from a lawyer then they filed for summary judgement. They are my bills so I can't fight them.We called the lawyer and made arrangements for payment(wife said he was nice about it), but he said he still had to go to court(so he could get paid) and if we missed a payment then wages would be garnished. So should I still go to court? Should I file a motion with court so this is noted? Should I ask them to send me a agreement? After its paid will it all be noted on credit report, or do I need to ask them about that? Thanks for opinions, and any info you can give.

First, what type of validication did you receive? Anything less than a notarize copy of the original is not valid.

Yes, he has to sue you to get paid that is why he file for summary judgment.

Is the attorney respresenting the plaintiff (creditor)? You need to go to the hearing and demand they produce the original contract, and the plaintiff must be present, attorney cannot testify for their client, not by word or brief, only the plaintiff can testify.

If the plaintiff doesn't show move to court to dismiss with prejudice, lack of jurisdiction.
