View Full Version : Can you force a child to visit his father

If a child is vehemently adamant he or she does not wish to see the parent a court has given visitation rights to, does that child have to be forced to do so? Keep in mind, this child tried to jump from a moving vehicle rather than see that parent. The child in question will be 12 in January 2014. Thanks for any information you can provide.

What is the reason the child is giving for being so adamant about visitation ?

You are required by the court order to make the child available for visitation. You are not required to physically force or allow the other parent to physically force, the child to go with the other parent.

However, if the child does refuse to go with the other parent, you would have to go back to the court immediately to ask for a hearing on changing the visitation or you could be found in contempt of court.

At 12 the child will be listened to, but will need to explain why s/he doesn't want to visit. The child will probably be required to undergo some counseling. The court may order some sort of supervised visitation that the child will be required to adhere to.

There is a much more serious issue, if a 12 year old child, is jumping from a moving car. And not obeying his mother. At 12,a child, should be doing what they are told, and that should be the end of it. There appears to be discipline and parenting issues here also,

If they could does not agree, the court can do many things, hold the child as a deliquent for failure to obey parents and send child to Juv court to have home studies. ( less likely to happen but possible) The court could find parent who did not force child too, to be in contempt. Even give non custody parents right to file for more rights.

Unless the child is in danger, if the child just does not "WANT TO" you force him to go and not let a child run the house
