View Full Version : Caught Shoplifting - section 334(b) ccc Theft under $5000

I'm 67 years old disgraced lady who was caught shoplifting an accessory just worth $8 by Wal-Mart security. The security called cops who arrested me and issued me an appearance notice and charged under section 334(b) ccc Theft under $5000. I'm not sure what I was thinking when I picked up the stuff, this is my first ever. I have no previous history what so ever. God knows where was my mind at that time, I don't even wear the stuff. I immigrated to Canada as a permanent resident about 4 years back sponsored by my son & daughter in law and I'm going through a depression treatment and am taking anti depressants daily trying to adjust to the new culture. I would like to know if this incident can be discussed by Wal-Mart to apologise so that they take their complaint back (wonder if that is a possibility). I'm ashamed of the act and it has caused nothing but embarrassment & disgrace. Further just in case it it is not possible or not suggested what can I expect to happen during my court appearance. I live in the PEEL region in GTA (Ontario). What can I do to avoid a criminal record?

My appearance is in mid September. I don't know what to do neither I know how to tell this to my family. Should I hire a lawyer?

Would this impact my renewal of Permanent Residency which is approaching next year. Would I have a criminal record that will prevent me to travel like US / Europe to meet my other sons?

Please advise this disgraced lady, I'm really ashamed of myself.

I wouldn't put a bet on thinking this could be recinded by WalMart by speaking tlo them and asking them to forget it after apologizing. They go through this almost every day. Don't think you will have a criminal record, but the courts do take a dim view of non citizens living in Canada under the good graces of the Canadian government committing theft, albeiit a very small one.

I would tell your family because this may impact your future travellng plans; hire a lawyer and go to court and take your chances the same as everyone else. You may get off with community work somewhere, ordered by the Judge.

If I do not get a criminal record, does this mean I will have problem in renewing my PR status in Canada?

Do you think I will have problems in visiting US or Europe? Does it mean I will not be able to ever visit my family there?

Do I wait what they have to offer me in the first court date or should I hire a lawyer day 1?
