View Full Version : Can the park owner put a lien on my home?

Ok, so I had been paying my lot rent by cash, check and money order. Well 5 months go by and the drug head lot manager decides he is going to knock on my door and tell me I am 5 months behind! Oh hell no I am not! He tells me if I will get him pills he will take care of it!! Yeah I know right! Well the owner goes on saying I owe him $900 and I inform him of the situation and he is still trying to make me pay the 5 months that I already paid and says he is getting a lawyer and is going to have a lien put on my home that I own! Need I remind you we have lived here 3 years never had any kind of agreement or anything. My husband leaves for 14 months for work and he tries this with me! Is it legal for him to try and do this to me? Can he put a lien on my home even though I have paid lot rent and his drug head manager used it for his habit??

Sadly, if you don't have receipts/money order slips/canceled checks, etc, he can.
Never ever pay for rent in cash without a receipt.
Liens can be put on homes, but what that means is that they get paid only when you sell the home.
They have to go to court to get the lien, and you can challenge it, but chances are you will lose. The judge isn't going to listen to stories about drugs and asking for pills.
Can you move? That won't stop the lien, but you might get a better management.
AGAIN - get proof you paid each month!

He can sue you in court, you will need to show reciepts, you will have copies of checks though the banks, you will have saved receipts from money orders.
So just tell him to sue you, a lawyer can not do anything but sue you, only the court can put a lien after they win a law suit
