I have been married for 34 years. I found out on July 22, that he is having a affair, so I told him to get out. He has not paid a bill or house payment for over 7 years. He has not bought anything for this house not even groceries. We have grown children there none living with us. What is my rights. He is trying to take everything!

Just like a stay at home mom that never work outside the house... he's entitled to half.

And Alimony if you make more than him.

Yes. He spends all his money on drugs.

This house was my mothers house. Before we refinanced it.

Yes but he use it all on drugs.

Doesn't really matter... 34 years... everything is considered both of yours.


Except inheritances are not considered community property, or part of a divorce settlement, if you bought and paid for it after marriage... even if it WAS your parents... then its an acquisition not an inheritance. That refinance probably changes its status..

You really do need a lawyer... if he gets one and you don't... guess who gets the better deal?

You hire an attorney and file for divorce. If the house is in both your name and his name on the deed, he will be entitled to 1/2 of the house and 1/2 of most other things.

Does not matter what he used his money for, unless you can prove he is using drugs and that is almost impossible, it will never make evidence in Georgia.

Only things you can prove as evidence under the rules of evidence are normally allowed. You may be able to tell your side of the story, but to be honest, in almost all divorces both sides lie about the other, so without proof, judges put little faith into statements.

If you both work the lower paying one, may ask for support from other,

In Georgia except for child custody, the reason for the divorce really does not matter, so adultery will not mean much to judges, far to common, in divorces

Adultery is a misdemeanor in Georgia but I don't know any states that actually convict or give much wight to it any more, It seems to be on of though laws like it is illegal for a man to war heels more than 1'' high while chewing gum.

Get a lawyer... get it in your mind you are only going to get half and no more... or you are going to end up with far less and the Lawyers will be the ones that get everything.

The more you fight this the more of the assets will be going to legal fees... both yours and his.

What's a law? Adultery? You want to prosecute him criminally for adultery? Good luck with that!

No Chuck is right, You file for divorce and try to get the best distribution of assets you can.
