View Full Version : What happens Violating Felony probation with a misdeameanor?

My boyfriend is in jail and has a court date next week for violating probation, on the cobb county jail website it says, violation probation type: felony indicted (when terms are altered) and a misdemeanor theft by receiving. He has been in there now for 14 days, his probation officer personally called me when he went to jail and said that he was not going to be in there for a while and it would probably just be a couple weeks but I am not really sure because I don't know what is going on I just need some advice.

Sounds like he has a really nice PO to go out of his way to assure you he won't be in for long that's always a good thing.

Only the judge knows what will happen. Unfortunately, you have to wait. Just like your boyfriend does.

Yeah and its really hard to say. Have you had any contact with him since he has been in jail?

^ yes I have had contact with him he writes me letters and I go visit him. He thinks everything will be fine but he doesn't know his probation officer was really nice and said he would probably be fine.

This is the legal board. We give legal advice.
What might happen is that he may have to spend the rest of his probation behind bars depending on his original charge and why he violated.

Well there are a lot of factors to consider so it is really hard to say what will happen so it really is up to the Judge but he might want to consider hiring a lawyer.
