View Full Version : Am I obligated to a 12-month lease if I never signed my new lease

My 12 month lease expired 5/27/13 and per phone conversation with management I agreed to a new 12 month lease. However even after I reminded them that I did not sign it they have yet to give it to me for my signature. I'm going to be transferring my job out of state in the next couple of months. I would be willing to give them notice now that I will vacate 12/1 and possibly move sooner if they requested. Am I obligated to a 12 month lease?

Most contracts have a automatic renewal clause in them. If you agreed to a 12 month lease then your obligated to it. There may be other clauses that say what the penalties are for backing out of it. So read your contract.

cdad--I read my old lease and know what the penalties are for breaking the contract, however I did not find any automatic renewal clause.

Any question on law needs to include your general locale as laws vary by area. Its possible local laws mandate an automatic renewal.

However, since you did not move when the lease expired AND gave verbal agreement to a renewal, a court may agree you are obligated. But talk to management, they may agree to let you be month to month until you know when you have to move.

You asked them for a new lease to sign; you didn't sign such an agreement. Until you received it and signed it you would not be bound by it. So you are currently month-to-month.
