I recently was a victim of violent crime I testified in court against a person who harm to me and put them in prison victims witness program assisted me and relocationprior to the relocation I lived in my RV on a friends property which she rented he also had to .testify at this trial and after the trialing moved away as well the trailer that my friend lived in and rented he gave to a friend / family member to move in since I moved out of the RV I have been by there several times to get my RV and have been given hassels each time. Now these people have broken into my rv and have people living in it and destroying it. I recently called the sheriffs and they did nothing. They told me that I need to look under repossession laws laws and that id have to pull my rv off the property onto the rd for them to allow me to take it otherwise I have to take them to small vlaims court. This does not seem rt to me. #1.It is my property I haven't registered it ibut I have the title and bill of sale, #2 it was lock up like fort nox and they have broken into it#3 why would I have to reposses something that is already mine? Some one please help I need help with this

Is your friend holding it for what they claim is money/rental space they feel you owe them? Did you sign any agreements with them? I suggest you take it to small claims court like the police said. Even though you have a title, it seems the police do not want to get involved and want to treat it as a domestic dispute rather than stolen property for some reason.

Your story is not clear. Who broke into the RV, the friend who's property the RV was on? Who was giving you a hassle to get the RV?

I think they mean that the person whose property it is on is letting family and friends use it.

The owner of the property, can give you written permission to enter proper to get your RV.

Just go get it.

I live on the property when my friend lived there and had no agreement not written nor verbal was ever done between myself or anyone else, not even between me and my friend. It is rental property and when my friend gave up the place he gave it up with everything he owned in it and gave it to a person not related but he calls her his daughter because she was homeless with out a place to live. Now she lives their with low lifes boy friend included. And they've allowed people the know to break into it and live .these people nhave known from the day I moved they've known I would be moving it. It has some running issues so I have been there a couple times to work on it to get it rhnning so it could be move and each time I've told the id be back again. Now there claiming I owe the owner of the property money which I do not and have never even spoke to the owner. It was the new people in the place that has allowed people to brake into it and people live there

I attempted to go get it and pull it to where it will be stored but the people that are now living init have a pit in the yard and have locked the gates around the property

Did he actually give them the property or just allow them to live there? Is he still listed as the owner? If he is, then get him to give you a letter stating that the RV is yours and you have the right to move it. You can then go to pick it up. If they won't let you, call the police.

OP's writing skills leave much to be desired, but as I interpret it, s/he left a motorhome on another person's property. That person allowed third persons to move into it and now won't let her/him onto the property to retrieve it. The police refuse to act.

I would apply to the court for a writ of replevin. Unfortunately, in most places small claims court cannot issue such a writ, so OP is going to need to seek justice in another court.

No he is not yhe owner he was y he renter at the time and now the people whom are now the renters are the people I'm having problems with. But I will say that the district attorney and people whom procsecuted the man that hurt me . They know the rv is mine because it was in the trial thst was one of the things that were argued about wheather it was a vehicle or a home because it's a motor home so there's records there that state I own it and it was my home because they charged the man with 1st degree burglary for breaking in it and beating me up. And now the officers on the streets do nothing. The district attorneys investigator knows as w r ll cause I use to live across the street from where his home is.

What the DA knows is not an issue. If the friend who let you leave the RV there was only a renter and there are new renters, they control the property. And you WILL need a court order unless the owner will give you permission to enter and remove the RV.

I don't see that the criminal case in which you testified has anything to do with this. And if you are indeed in some kind of witness protection program, how can you be seeking to recover the RV? To do that would seemingly make any effort at protecting you futile.

AK makes a good point. If you were relocated as part of a local witness protection programs, then the DA's office that protected you should help you get your RV back. Have you spoken to them about it?

But the bottom line is that you need either the owner's permission or a court order to recover the RV.

Thank you everyone for your help . Yes, u are correct that I'm in the witness protectoon program and yes it jeopardizes my safety every time I have to deal with it . I will contact the witness protection program and see what they can do. The Da is part of the program maybe he or they can pull some strings. Otherwise can u tell me what the writ of replevin is ? Is it the order to recover property
