I am applying for a resident visa in Canada ( Manitoba Provincial Nominee Program) together with my 5 children. I am away for ten years working abroad ( 2003-2013) and had been home just recently. The last 6 years of being away was messy and troubled , my husband abandoned my children and since then we haven't heard from him. When I came last June 14, I even went to his relatives to ask his whereabouts but failed to find answers.
What my dilemma is , the Canadian Embassy is asking a proof of legal separation since we will not traveled with the father of my children. How can I get a legal separation when I do not know his whereabouts? Please do enlighten me.

This has nothing to do with the code in the Philippines. Have you explained your specific circumstances to the Canadian embassy?

If, in fact, Canada requires a "legal separation", you should be able to get such a court order, either from a Philippine court or a Canadian one, serving your husband by publication. I suggest you contact an attorney (in either country) to see about doing that.
