Been married seven months. No children. No property. Rent a house from my dad. No mutual assets except for cell phones. I have a 401k worth $28,000. Is she entitled to any?

Why divorce, what is happening, no one changes that much in 7 months, so how long did you know them ?

The law on divorce if in the US is based on state law, so we will need to know where you are at.

We live in Ohio. We dated for 12 years and finally decided to be married. I have a 19 year old daughter that my wife doesn't get along with at all. She has actually threatened my daughter and refuses to meet half way on this issue. She's become very bitter. I don't know what to do with her.

Chances are the 401 K will be regarded as a pre-marital asset, so that it wouldn't have to be divided with your wife. However its possible that the fact that you dated for 12 years might be cause to make it marital property, if by "dated" you mean lived together.

We never lived together or shared any assets. Seems it should be relatively painless. Am I wrong?
