My husband left me 2 weeks ago and is in another relationship is that adultery if your not legally separated for a year?

It's adultery if you aren't legally divorced. Being separated or not has nothing to do with it.
From freedictionary.com -- "Voluntary sexual relations between an individual who is married and someone who is not the individual's spouse."

Yes, she's sure. But what does it matter? Adultery is no longer prosecuted as a crime. And since, most areas have no fault divorce laws, you don't need it as grounds for a divorce.
So it really doesn't matter whether he's legally committing adultery or not.

Since we don't know why the OP is asking lets try to keep in mind that Adultery could be part of a prenup contract. Also we don't know where the OP is located.

It is adultry and at least in most of the world, it is not a crime. It can be used in divorce court but even there most do not require cause any more.
