I am writing in that I am just trying to make some sense of what happened at the DMV on 7-8-2013 I am sorry it is a bit wordy but it's the only way I can explain what occurred .
Recently I submitted a question on this site regarding the simple renewal of my drivers license and an issue involving my cane.
My orig question has conf and thank you so much for your very speedy reply.
On 7/8/2013 I and my friend Alex went to the local DMV # R01 to simply renew my drivers license. I would have done so online but had used that option on the previous renewal and was told I would have to go to the DMV personally this time. I had no problem at all with that and did so on that date.
Upon arriving at the DMV I was told the fee would be $48 and just to have my IDs and license available.
When I finally was called to a clerk who apparently was in training I was later told he took my ID and then had me take a eye exam which I passed on.
After taking the eye exam the clerk noticed I had a cane with me and asked if I require it and I said yes to walk long distance as I had and just renewed my handicap parking permit.
The clerk immediately said I now needed to take a new road test and both I am my friend looked at him and said "why would I have to take a road test just because of a cane that has nothing to do with me driving at all" the clerk answered "that is the rule if you have a cane you need to take a road test before you can renew your DL." We both looked at him and my friend said that doesn't make any sense and I said so if I say I don't need it then I don't have to take the road test again.. The clerk laughed and said " I already saw you with it so you have to take the test again". I became annoyed with this and again asked what one thing has to do with the other. He shrugged his shoulders and said "I don't make the rules but that is the rule" so I was sent to sit and wait for a road test examiner.
After a while waiting outside by the car the examiner showed up asking my name and then another examiner came up asked him something and he said Mr Kagan please wait here I will be right back.. What turned out to be 20 min waiting he finally showed up and we got started.
He checked the car and mirrors and told me to back out of the parking spot and at the stop sign make a left and proceed to the next stop sign which I did. My friend was on the sidewalk right behind me and able to see everything up to the second stop sign.
I came to the stop sign stepped on the brakes then rolled about 3 ft forward so as to see both ways to proceed at which point the examiner doing something on his clip board and in a attitude said "Mr Kagan are you aware you just passed a stop sign and did not stop? I still sitting at the corner said "I did stop and then moved to see both ways. He turned to me in a huffy way and said I hadn't stopped and I said "excuse me but I did and even at the end of the road test when he mentioned this again on why he wasn't passing me in front of my friend my friend immediately said he saw me from where he was standing and saw that I did stop at the stop sign.
Well after the problem with the stop sign I made a right and proceeded to the next stop sign which I was told to make another right. After stopping I turned right and proceeded to the end of the back of the shopping center and on the left was a spot with two poles and he told me to make a left into the spot and stop. I did this with no problem at all and was then told to back out and go in the opposite direction and again drive till he would say stop.
I backed out and turned the car to face the opposite direction I had just come from and started to drive at which point the examiner in another annoyed way said "I asked you to back out and proceed in the opposite direction" I said and by now I was getting very annoyed with this guys attitude but I said that is exactly what you said to do. I came down this road parked and now I am going in the opposite direction on the same street. He said "I was referring to the street behind us" I said oh I'm sorry but you didn't say that and do you want me to turn around and go that way instead. He said yes and I made a 3 point turn to do so.
Finally we continued the exam and went down a empty lane in the parking lot of the shopping center and he said " okay now stop here and then proceed at a speed of 20 mph and when I tell you to stop you must stop immediately in a save way. I did this with no problem at all. The examiner then said " in a safe speed drive in reverse till I tell you to stop" I asked at 20 mph he said a safe speed again". I did this and after he instructed me back to the DMV test parting spot told me to stop the car and got out.
My friend Alex came over and the examiner said " you didn't pass as you went through the stop sign at which point I asked which stop sign and he said the one we spoke of and my friend asked me which one I said the one at the end of the block by the cross street and he said to the examiner " he did stop there I could see him clearly from where I was standing and that I did in fact stop there and he said in fact I was wondering why you were sitting there so long,. I said because the examiner said I hadn't stopped .
Then the examiner said you also while driving in reverse veered off to the left a bit and didn't remain in a straight line while going in reverse. I said " it was a parking lane parking spots on both sides and when he pointed that out I asked if I could do it again and he just said just proceed back to the starting place.
He told me I had to retake the test but had to schedule another day so I went inside and a woman called me over to schedule and I asked her out of curiosity why I had to take the test to begin with just because of the cane. She then asked me why and what clerk told me to take it. I pointed him out and she went to speak to him then bringing him over to me and asked if this was the clerk who assisted me in the beginning and I said yes. She then said something about they have to check all people with canes or other things and that is why I had to take the test again. Me and my friend both looked at her and said " what does that mean and she said please wait here and got up went over to the clerk again then went to another room returned and then went to speak to I believe a manager. We sat down again while watching this woman run all over the place with my license and paper work and my friend said to me " its like the clerk who we found out through the woman we were talking to was in training but its like he made a mistake in making me take the road test and now they are trying to cover it up. Why else would they be going through all this nonsense if you just failed the test.
I thought about it and realized also something was going on this wasn't right.
Finally she called us over again and said she couldn't give me my renewal but I would have to take the road test again but she would give me a 60 day permit till I returned to take it again.
I again said something is not right here but I will take it again regardless and again stated " I don't understand what a cane has to do with driving" she said Its just the rules.
I will go to take the test again this week.
My question is to me this was a cover up of the clerks error and why should I be held accountable for his mistake.
Your response to my original question about the cane requiring a road test also stated it was not necessary.
I just would like some answer to this. I feel I was treated wrongly and would like some closure on this..
