View Full Version : How can I get my sons fathers rights terminated

My son is Two Years Old. The Father has not been there for him Emotionally, Physically or Finically. He left the state with an underage girl, ever since he's been in and out of Jail for stealing and who knows what else. He was Physically, Emotionally and Verbally abusive during our relationship. When my son was a newborn he yelled in his face for crying which made his crying worse. Im afraid of him and I'm afraid for my son and his well being when it comes to his father. I feel along with everyone else in my sons life that his father should stay out of his life. How can I go about getting his rights terminated

Marry someone and convince them to adopt your son... even then the father has the right to contest it.

Meaning none of the excuses you gave are reasons a court would terminate his parental rights... particularly if you can't tone down your obvious hatred or him before you get into the courtroom.

But if you get married and you and your husband want to try and adopt... the father might be willing to go through with it if you are civil enough to him during the process... he can make it easy or difficult out of spite. Because right now... absent a court order.. his rights are equal to yours.

Go to court for full custody. And then if he wants visitation you ask for it to be supervised.

However custody doesn't terminate his rights... only clarifies and restricts them.

This was posted in the Family Law forum. Answers here need to conform to established law. So the answers you got were accurate, legal and good advice.

That courts are very reluctant to terminate parental rights. They will only do so in rare circumstances.

At this point the father is not exercising his rights so the reaction of a court will be to wait until he tries. If, however there is a step father willing to adopt your child they will consider issuing a TPR to clear the way for an adoption.

You made a decision to have sex with this man. That decision means you have to deal with this man for the rest of your life unless you can get your son adopted out.
