View Full Version : Two people on a lease and one person moves out. Who gets the deposit?

My ex and I started a least together but after a domestic assault charge he moved out of state to get the charges against him dropped. I moved out 3 months later. Do I get the deposit just in my name since I was the only one living there and paying rent?

If there are two names on the lease then most likely the landlord is going to make the deposit payable to both names. If it should be payable to only one person then the landlord will probably require some kind of consent from the other person. You're going to have to work this out somehow with your ex.

I no longer speak with my ex because he was harassing me after the domestic violence charges were filed against him.

That doesn't matter. If the landlord returns the deposit, both leaseholders are entitled to share it. Did the landlord release him from the lease? Was he aware that he had moved out? Did you break the lease to move out 3 months later?

You can try speaking to the landlord about it but I think that if you don't have consent from him then the best you can hope for is that the landlord will issue 2 checks, half to you and half to him.
