View Full Version : Ex defaulted on loan I am cosigner and title,reg,ins in my name does he have rights

I am in ny state, my ex is on a vehicle loan I am the co-signer. The title and registration and insurance is in my name. He is 2 months behind on payments and the car is to be repo in a few weeks. I tried to be civil and he refused to give it to me to deal with so I had the car towed to me and paid to have a key cut. The car is a 2011 and he has blown the motor or transmission. $18,000 is still owed on this car. He put an after market stereo in it and came to my house today threatening me that the stereo is his and he is coming back with the cops, I don't want him doing any more damage to this car since he still has a key and I don't want to be a prisoner waiting for him to show up. Does he have any rights at all to the car or stereo. Plus I did give him a few days after I told him I was taking it to get his stuff out and I put all his mail and clothes in a bag to give to him . Also can I sue him for the missed payments and the money to fix the car. He is getting a large settlement and will have the money

The car is in your name, its your car. Otherwise you couldn't have had it towed.

Yes, you can sue him for missed payments.

Take out the stereo before it is repo'd, of course. What you do with it is up to you. He won't believe that you have any right to it, but you do - it's your car and he added a fixture to it. But angry exes are too angry to go for this, so I would let him have it. In fact, I would let him take it out with a cop present. The cop will understand that the car is in your name and he has no right to it. Take off the plates and go turn them in ASAP, and cancel the insurance when you do.
