For year 2006 I was on opt till march 01... and H1 B for rest of the year.. . I came to us in July 2002 from India
Should I file 1040 nr or 1040nr -ez.. I know this is a common questions and have read a few... but I wanted to know what's the difference in both.. :confused:
If I can file 1040nr-ez.. can I claim itemized deductions on line 11.. this is equal to my federal and local taxes which is more than standard deduction :cool:

Also if 1040 nr can I claim 5150 and 3300 deductions.. I am also claiming student loan interest deductions. Gross income after these deductions is about 40,000

You must file a dual-status return (which an amateur should NOT file; get professional help).

You CAN claim the $5,150 standard deduction, the $3,300 personal exemption, PLUS deduct the student loan interest.

I assume I have to file 1040 NR and deduct the 3 things from it.
I got turbo-tax and it did 1040A with same 3 deductions

Turbo-tax is for resident aliens; the computations WILL be different.

ATE is right. You are a dual status alien and should file a dual status return. If you are married, you might be able to make an election to file with your spouse and be a full year resident.

See Pub 519 or hire someone for the dual status return.
