Can creditors garnish CPP Disability and LTD payments? I get my LTD payments from my employer and was subsequently approved for CPP. As a result of my disability I am able to work and an now receiving half of my salary which is barely enough to live on. I am being harassed and threatened by creditors. One company said the will obtain a certificate of employment. What is the purpose of this? I am still officially employed.

Further to my previous ? Can creditors garnish money from my bank account. As my CPP & LTD payments are direct deposit.

If a creditor has a judgement against you they can get a court to issue a writ of execution against you bank accounts or a writ of garnishment against your salary. But they need to obtain a judgment first.
While public disability payments are exempt from attachment, private ones may not be. Also, once in your bank account they would be considered commingled funds and open for attachment.

I'd keep two accts. One they can touch and one for any payments they are not suppose to touch. Of course you have to make it clear what they legally can not touch.

Thanks for the information. I recently changed banks and its joint with my son. Can this still be touched by the courts or creditors ?

Um.. you are aware this is supposed to be ansewed on your original thread and not as a NEW thread?
And yes it can be touched... just pay what you owe them and get it over with. If its got your name on it at all... then its fair game.
