View Full Version : Trailer park landlord wants us out

We've lived here for 13 years without a lease now he decides to make rules saying we cannot have guns or dogs in the park , I'm not giving up my dogs or my guns , can he evict us? We live in Pennsylvania and pay our rent

Is everyone having to comply with these new rules? How were you notified of the rules ?

You have no lease. The landlord can impose such rules if he wants as long as he gives sufficient notice and applies the rules to everyone. If you don't comply, you can be evicted.

I'm not even so sure that he has to apply the rules to everyone. If your dogs and guns have been the subject of complaints while others haven't, he can consider them a nuisance or hazard, specifically in your case.

Agreed, but only if he can produce complaints.

No, my next door nieghbor has guns , and is not following other rules, he put them in an envelope and put them on my car.

My dogs and guns are in the house , my dogs don't sit outside and bark like the others do , I don't brandish my guns , I take them out for hunting and target shooting , niether of which occur within miles of the park

If you believe the landlord is targeting you, you may have a cause of action for harassment. But in any case, he's the landlord and since you don't have a lease he can terminate your tenancy at any time with proper notice.

If the landlord wants you out, do you really want to stay there?

Do you own the trailer and are just renting the space or is the entire thing a rental?

Then your going to have to look for a space at another park and the expense of moving or depending on the age of the trailer it might be best to sell it outright. Have you tried speaking to the owner of the park? Have you spoken to others to see if the received a copy of the new rules? Unless there is a real problem going on then you are within your rights to own a gun. Also because of precident that has been set and again so long as there is no ongoing problem I doubt they could evict you for having an animal either. Since you own the place you live in and rent only the spot its on there are different rules than general rules of landlord tenant.
