Not married my name is not on birth certificate, but I do have a DNA test that prooves I am the father and did pay my child support. The mother abandoned my daughter at her parents home to go with her violent and two time felon boyfriend, me and the grandmother have filed for her to have guardianship, and I also live in the home of the grandmother. If she wants to come for the child what rights do I have as the father and the grandmother having filed with my consent for guardianship?

What is the legal status?
The grandmother asked for guardianship and it was or wasn't granted?
You asked for custody and it was or wasn't granted?
I need to know exactly what the status is.
If the mother is going to take the child and you can PROVE the child will be in emotional or physical danger you need to go to Court immediately and ask for an emergency order that the grandmother or you receive full custody and that the mother's visitation be limited.
If there are no Court orders the mother has the same rights to the child that you have.
You pay support to the grandmother?

If I were you I would file for sole legal and physical custody. Then grant guardianship to the grandmother. This will prevent the mother from just showing up and taking the child.
Its not clear what court actions have been taken to this point. Until and unless there is a court order awarding custody to someone, then you both have equal rights and she can show up and take the child.
