View Full Version : How to evict non-lease roommate in Alberta

My partner has been on the lease in this house for the past 7 years, and the current roommate has been here approximately 4 years but has never been on the lease. I moved in 2 months ago and signed myself onto a new lease with my partner on June 1st.

The roommate is disgusting, a hoarder, rude, unemployed and incredibly selfish. She did pay a security deposit to my partner when she moved in, but there is no record of this anywhere. We told her she must be out by July 1st, and we will give her her deposite back once all her things are gone and we can see if there is any damagae. There is so much stuff in her bedroom that she has to sleep in her hammock, plus all the junk outside and filling a large basement suite. She is not evil, she just should live ALONE! And she doesn't clean her cat's litter, which in my books is a heinous crime.

We are worried that a) she won't be gone and b) if we try to do something like change the locks, she will call the cops or try to get us in trouble. The landlord also definitely wants her out of the house.

What kind of letter do we have to write? Do we need the landlord to sign it also? Can we give her 14 days or does she get more? Can we throw out her possessions if she hasn't taken them away by the date on the letter? Can we take the cost of removing the junk out of her security deposit?

We are living in Calgary, Alberta, Canada.
