My mother legal separate her husband around the end of 1999 or early 2000. I do not know who the lawyer was at the time. I would like to know how to obtain a copy so I can have medical rights for her. Also would like to get her divorced from him. Please advise. Thanks

Go to the Clerk which handles divorces for the Court in your area - in my State it's the NY Supreme Court.

The County will determine the exact location.

Do you have a POA over her? If so why?

Do you have a POA over her? If so why?

And why do you ask? What does the answer possibly have to do with the OP's question?

You do understand that OP wouldn't need a power of attorney to examine public records in the courthouse?

Possibly because the OP says he/she would like to "get" the mother divorced from the husband. I see no indication that this is what the mother is thinking.

You did read the whole question and not just parse it out? The OP Stated:

I would like to know how to obtain a copy so I can have medical rights for her. Also would like to get her divorced from him. please advise. Thanks

It sounds like they either are or want to have a POA to accomplish these tasks. They aren't stating that the mother wants to do this. Notice the use of "I".

A POA would not allow OP to "get" OP's mother divorced, if that is what you were thinking. OP never brought the subject of a POA up, you did..

I'm thinking that by "get" he/she meant "assist" Mom to get.

If you know it was done, does not your mom have her paper work ?

Also who was the attorney doing the separation paper work ?

From either a copy mother has, information from the attorney, or to to the court and ask for copies of the records, adn/or a record search

Divorce/separation records are available on line in my State. Anyone know where OP is?
