I currently pay child support,and my child's mother receives ssi.My child stays with me,is it against the law for her to receive ssi payments and child support.and what can I do to stop the child support,my daughter is 17.I have no problems paying arrears but they still taking money out of my check.and she leaves with me... there is something inhumane about this...

How long has the child been living with you? Are you only paying arrears, or is that paid? Why does the mother receive ssi payments? Is it due to the child?

Have you gone to court about this issue?

If not, you're paying a previous court order. If the circumstances have changed, you need to go back to court. Courts don't watch you and the mother and then change things when circumstances change. It's up to you to go to court to let them know the new circumstances, and have past orders changed. Have you done that? If not, why?

If you owe arrears it doesn't matter who the child currently lives with. You owe the arrears to the custodial parent while the arrears were building up. Nothing inhumane about that.

If the SSI is for the child, then yes it should go to the custodial parent;

Have you gone to court for a change in the custody/support? If not, how can you claim inhumanity when you have done nothing?

And we know you need answers, why else would you post on a site like this. But it will help you get answers uf you post in an appropriate forum (your post was moved here) with a descriptive title.

Who is suppose to be receiving the SSi payments? Are they suppose to go to the mother or the child? If they are to go to the child then the legal custodial parent has the right to collect on it. If you are the one with court ordered custody then you can get it changed.

Got to agree with what has gone on. The responsibility to report the change of custody/living arrangements to the Court was yours. If you did nothing, the Court doesn't know anything about the circumstances.

If you are paying on the arrears you must continue to pay the former custodial parent until the arrears are paid in full.

How does your child qualify for SSI? Or does the mother receive SSI and child support? If so, does she report the child support as income? As a practical matter it appears you did not pay any support (that's why you owe arrears) and I'm sure that factored into the mother's award. She would not report "income/child support" was on paper only, money which she was not receiving.
