This has been going on on since October and also I have a sewer fly infestation from this and the landlord has been aware what can I do now to take matters into my hands in a legal way

Hello NyckJeff: You are not telling us whether it is a house or apartment...
In the interim: You have to find the source of the smell. If your house is on raised foundations, crawl under the house to see if there is any broken / leaking sewer pipe. If you have septic / cesspool, than it my be full and overflowing. Also, check for saturated ground around your property. You may have blocked or broken leech field pipes. If the smell is inside the house than make sure all traps are filled - especially floor drains and showers / tubs / sinks that are not used every day.
Since open sewer is health hazard, landlord should do the inspection in timely manner.

Don't do anything except contact the local Health Dept. If you get involved and something happens, you could get sued.
