I have a 3 soon to be 4 year old son. When I was pregnant, I asked the doctors when I conceived and the date they kept giving me was no where close to the date that I slept with my ex. The guy I was signed the birth certificate and that. I recently did a home dna test and found out that the guy who signed my sons birth certificate is not his bilogicial father. I want to ask the court to do a dna test but I am scared that they will do something to me for what I did. The biologicial father told me that if a have the court do a dna test he will sign rights away. Can he sign his rights away and will the court come after me for not doing a dna to begin with?

Most of this depends on where you live. Since he signed the birth certificate and this much time has passed there may or may not be a challenge to it. Where is this happening?

You had a reasonable expectation that the person listed on the birth certificate was the father. So why do you think you would get in trouble. As of right now, the person you listed and who signed the birth certificate is the legal father Unless he wants to challenge paternity, you need not do anything.
