How can a father gain sole custody of his son in NH? The wife is currently being charged with endangering the welfare of her son and felony criminal threatening. The father has been granted a restraining order and temporary full custody with the mother allowed 2 hour supervised visitations (it has been 2 months and she has not initiated these visits with the center yet). In the divorce clause, for the safety of his son, the father would like to gain full custody and have her rights removed. She previously lost custody of a child from another relationship, but the details of this case are sealed to protect that child. He is very concerned for the welfare of his son and unfortunately is not in a position to hire an attorney. Any guidance is much appreciated.

First, forget about getting her rights removed. That is highly unlikely.

But if the facts are as you stated, then you petition the court for sole custody. You list previous history, the reasons the court granted what it did, the mother not exercising the visitation granted her. Family Courts are pretty user friendly. If the mother doesn't hire an attorney, then you should be able to get away without one.

You might check with a local law school. Many have clinics that will help you prepare paperwork and strategy.
