If you feel that moving in with your dad is the right thing, then do it! Make sure you know why you are moving in with him though. As for your mom, it's not healthy to have a bad relationship with people you love! Talk to her about it, but don't ask her if you can move, tell her that it's the right thing to do to help yourself! Make sure you keep in touch with your mom, because whether is seems so or not, she loves you. Try as hard as you can to make things between you two better. Hope this helps a bit! Xo

This question was asked on a law board. The rules are a bit different in this section and all answers need to conform with current law as we understand them.

The OP can't just choose to move out. The parents can agree and the father can go to court for custody. But the way the law reads its up to te courts to make that decision.

At 17 they can't move out on their own either.

For you to move in with your father requires a modification of the current custody order. Your father needs to file for a change in custody and it has to be granted by the court before you can move.

How long until you are 18? It may take that long for this to go through the courts. Once you are 18, you are free to move.

You forgot to tell us what your dad says about this.
He may not be able to have a teen in the house while working long hours. He may prefer not to, even if he loves you. We don't know if you are studious and have a part time job, or flunking out and going wild and messing up your mother's house without any regard to what she does for you. Many teens are clueless about cooking, shopping, cleaning, laundry, etc. They track in dirt, put their feet on the couch, raid the fridge, spill food and drink in the furniture, and spend all day and night on computers and video games and music. How do you know your father won't end up feeling the same as your mother? I realize that sounds more like teen boys than girls, and you may be a girl from your ID, but we don't know how much you help your mother around the house, at the least, or stay out late with friends, or what.
In less than a year you are on your own. It's possible that both parents expect you to move out, get a job, or go to college. You should be thinking and planning and talking about that by now.
So what's the story?

This is the problem with 10th grade students posting on adult boards - from 10th grade perspectives. And closing an answer on the legal boards with hugs and kisses!

You will need to talk to your dad, he will file a motion in court to change the custody.

But at 17 most likely you would be 18 before this ever got to court

You can not just move, you could just be forced back by police. Father even filed against for not returning you, according to custody agreement
