View Full Version : Distance allowed to move children

Can someone please let me know what the law is about how far you can move. I'm only moving 75 miles to be closer to my sisters and my twins dad is going to try to prevent this by taking me to court. Do I have anything to worry about?:confused: :eek: Urgent as I was planning on moving within the next two weeks.

How often has he been visiting, are you going to assist in transport of the children to help make it easier for him not to have the added expense and time.

But yes he can try, it will be up to the judge, if he proves it is a hardship, anything is possible

Thank you Fr Chuck. I use to let him pick them up from school every day and had to put a stop to it because on two different occasions he had been drinking when he picked them up. Now it is only if I absolutely need him to. And as far as helping with the trip... I would probably meet him halfway if not just drop them off..? Should I wait or move. I know anything can happen, but do you think a judge would move us back if I moved??

Ok, I am not a attorney who is a member of the bar in your state, so I can't give you direct legal advice, But if he is really going to file in court, you need an attorney and I would talk to the attorney before I moved just in case.

But a lot will depend on what your custody agreement says, most now adays are fairly clear about moving.

Normaly I have never seen anyone be denied moving less than 100 miles
