My husband was in a car accident 4/19/2013 in Ohio. Today the other party called and said they are having neck & shoulder pain. 5 days later. Can they claim that this long after? Also what is going to happen to our home? I am very concerned, I know it was our fault for not having insurance, but my husband has been laid off for 3 years & were broke. Any infor on what to expect would be appreciated. As far as we know the only damage to their jeep cherokee is a bent frame in the back.

If he slammed into them hard enough to bend the frame in the back... they very well could have back and neck problems. And many times it will take a month or more before problems may start.

Its only been 4 days. (today is 4/23/2013)... why do you think it would have been too late to make a claim against him?

If you had no money for insurance... the vehicle should have remained parked until you did. Most states require you to turn in your plates or get fines from the state and suspend your drivers license until you pay up.

What can you expect? Expect to be sued... expect to loose... expect to have a garnishment over your heads for at least 7 years or for the rest of your lives if they keep renewing the writ... as is their right to do. Expect anytime you get anything to have someone come and take a big part of it until the judgement is satisfied...

I know someone ( a longtime friend) who was in their situation... 30 years later he is still collecting whatever he can.. whenever he can off the person who hit him while driving uninsured.
