My parents are deceased and I am executor of the will. My brother continues to live in my parents home and will not move out. He doesn't have a job, the house is paid for and I need to sell the house. His name is NOT included in the will that my mother left in regards to the home. He is destroying the house with having too many cats and the house is unbearable to live in. I need some legal advice on who to help me get him out and get this house sold. Simple, you follow the eviction process for your area (which you neglected to tell us). Generally this means giving him 30 days to vacate. If he doesn't make the deadline, you go to your local housing court for an eviction order.
