View Full Version : Can I collect expenses from a sublandlord who illegally sublet her home to me?

I have a 6 month written lease with my sublandlord. I recently found out that she did not have permission to sublet. Fortunately the homeowner agreed to sign a new lease with me directly and kick her out at the end of the month. I have to come up with a security deposit and deposits for utilities by may 1 as opposed to sept 1 when I had originally planned according to the end of my sublet. Do I have a right to expect my sublandlord to pay for those expenses since she lied and misrepresented this rental from the beginning?

Did you pay her a deposit? Did you check to see if she had the right to lease to you?

I would not pay either one of them a dime until this is sorted out - the landlord may not be able to 'kick her out at the end of the month,' and you will be out double costs.
You might have a right to expect certain things but I doubt that you will get them, and it would take going to court, and even if you win you might not collect (courts don't collect for you).
So... don't pay anyone yet!

Are you, in fact, occupying the apartment solely? If her lease prohibits sub lets, then the landlord can serve her with notice that he is terminating her lease. He can then offer you a lease. Starting when her is terminated. At that point you would owe a deposit.
