My probation officer apparently filed termination of probation paper work about a month ago to the family court in the state of Delaware. I am a juvenile. I was found delinquent of robbery 1st, offensive touching, terroristic threatening, and criminal mischief. Before that adjudication, my prior record includes escape 3rd degree, 2 counts of criminal mischief, and 1 count of offensive touching. My last sentencing was February 6, 2012.
The judge suspended level V placement, instead placing me on supervised level III probation for an indefinite period. It was the further order of the court that a zero tolerance for all conditions of probation be implemented upon me, the juvenile offender. I complied with all conditions of probation, and was under the impression that he filed termination of probation paper work about a 4-6 weeks ago. However, I was questioned by police last Wednesday about an incident with an abandoned house. They released me that night, and then contacted me on Friday to tell me that I will be arrested this Wednesday for criminal trespass 1st, conspiracy 3rd, and criminal mischief under $1000. I called the family court every day and evening since last Wednesday and they claim there is no docket number for the termination of probation paper work. They say there is no chance that it is sitting on the judge's desk, and it is not in a back log anywhere. My probation officer tells me he turned in the paper work for it. So I am left to believe that it was lost in the mail. And it will not be recovered. So my question is, since there is a zero tolerance for me from my last sentencing, and I did something to constitute a violation of probation, will I serve time? Will the judge sentence me to serve the suspended level V placement, despite being so near to termination of probation? My probation officer doesn't know about the incident yet by the way. I need urgent advice.
