View Full Version : Va probation and Maryland DUI Pbj

I was sentensed in Va in 2008
For uttering and attempt to obtain money under false pretense after this was my first time ever arrested and did about 60 days in jail waiting for my court date. I was given a suspended sentence which leaves me on probation until 2019. My probation was set so I can see my p.o. where I live in msryland. In 3 yrs I had no violations or new charges. In oct 2012 I got charged with d.u.I. and in December 2012 I received a pbj for that and currently dealing with that probation with the same p.o. my p.o. suggested in her report to VA that I be allowed to continue my probation since I am compliant and enrolled myself I n an intensive outpatient t reatment program to deal with my alcohol abuse. Is a judge in va likely to accept this reccomendation? Or am I looking at a lot of jail time? This is my first violation and my dui was handled in traffic court not criminal... thank you

What the judge decides in VA will be anyone's guess... but here in the Old dominion they take DUI cases seriously after a rash of high profile deaths caused by drunk drivers... That means the odds of something favorable to you will be somewhat reduced.

Well the d.u.I. itself was in Maryland I've already been senrensed. The Va hearing is just for my violation for getting a new charge

Then that might bode better for you... however you really are at the mercy of the court.
