If you didn't file for any status after marrying him and your visitor's / work / student visa expired yes you are illegal. The marriage does not automatically get you citizenship or any status, I know cause I married my wife in Florida (im from Canada) and we were told there is a mountain of paperwork to fill out and the fees are around $1000 - $1500 USD.

If you are planning to divorce him and haven't filed any papers then your in a mess there too, yes, if you re-marry you can apply but I don't know how they will view 2 marriages in 1 year plus and expired visa... it might be good to return home and re-enter legally.

I knew someone in the same situation. Honestly do not divorce your husband. Seek out ppwrk to get yourself established legally in the US. Have you worked? You can easily file all this stuff on your own, There are websites out there that give you the type of ppwrk that is needed and also how money is going to cost you. You, will have to go through an interview with the INS as well.

If you divorce your husband and remarry it will look suspcision and because you are illegal it may be harder for you to stay here in the states and you may have a greater chance in having to leave.
