If the mother of a child is receiving child support and ssi for the son and is not working, can fathers child support be raised if his income has not?

In many states, child support is calculated by a formula which factors in the incomes of both parents. Therefore if her income has been reduced, the amount calculated by such a formula would change. It depends, however, upon the law in the jurisdiction as to whether a change in circumstances has occurred. And, of course, her unemployment must be involuntary.

Many factors can impact how child support is set. Most states have guidelines based on a percentage of the non-custodial parent's income which is graduated depending on how many children are being supported. When there is a big disparity in income, or either parent is diabled or for a variety of other reasons, adjustments are made.
You should see a family law attorney in your jurisdiction and bring your current support order with you, as well as other pertinent financial information regarding your household income and the non-custodial parent's income, and be prepared to talk about the reason you require more support to be paid.
