View Full Version : State misplaces funds, and funds not received, any ramifications?

My son has yet to receive his child support payments, from his father, even though there has been an order for a wage garnishment. The employer has been sitting on it, for over 1 month, and no remedy in sight! The only source of income, is spousal support, and now since my checks are mailed directly to me, and not the SDU, they have been coming up missing in the mail. This has caused such severe undue stress financially, such as, my water and electricity being turned off. The employer, a CA corrections facility, has stated the my lost check, was lost in the mail, en route to me, and it will take up to 3 weeks to recoup another check, even though, they advised me, not to do a stop payment, just in case the check showed up! Now, I'm being told that if the check was cashed by someone, other than me, that I will not receive any money for the month of March, and there are no solutions for me at this time! This means that, my water and electricity, will remain off, until the beginning April, as well as, food becoming very scarce... this is my only source of income... I'm on disability, and have not received and award payment yet. What can I do to rectify the situation?

What State? In many States once support is Court-ordered to be paid directly from the check the employer has a specific number of days to respond. I just saw that it's California. Let me check.

You are disabled but are without any disability benefits?

INSIST that the wrongfully delivered/cashed check be investigated. You can go to the Police in many areas.
