View Full Version : Can't serve order to show cause papers to ex.

My husband has hired an attorney and her process server was not able to serve the ex girlfriend papers so he can visit with his 2 boys- then we hired sheriffs and the tried 5 times at her work and also could not serve her because her work said she no longer worked there or that she wasn't at work.. She put her house up for sale and we don't know where else to look.. We did catch her last week on the frwy and followed her to work, but since she works at a hospital she notified security and security blocked us from serving her.. police came and they said that we would have to try some other way.. So far it has been around 15 attempts and we can never catch her.. what do you suggest?? Help, we just want to see the boys..

Hello n:

Got to be sneakier. Hang out in hospital parking lot. Is her house empty? Keep trying. Did you check out service by publication?? I don't know if you can use it in a domestic case, but I'd certainly ask my mouthpiece.

Are you & your husband PAYING for this attorney? If so, it is her job to go through the courts to get an officer to have her served at work now that you know where she works. Security can not stop a police officer from serving someone, that's interference, that's a free pass to jail for that security officer. Right? Anyone feel free to correct me if I'm wrong, I'm just basing that on someone trying to interfere with my son's father being served for child support. Once jail was mentioned they stepped to the side and let the officer do their work.

Millec is right, kind of. Process serving is a job taken on by private individuals and by off duty law enforcement officers. Even off duty, the cops still wear their uniforms, though. However, while wearing the hat as process server, the cop has no more authority than the civilian does. However, people he confronts don't know that.

I'd try hiring a big ugly sheriff.

Sometimes you can hire a private investigator to serve the papers to her. PIs are not in uniform and surely she wouldn't know who they are, so she would not have a chance to run and hide. PIs will track her down and serve her very quickly! It shouldn't cost too much for that service?

Plus, if you are unable to serve her, then you should return to court and explain it to the judge. I don't know what they could do, but there should be something for her behavior and she should be punished if she can't cooperate!
