My daughters fathers name is not on the birth certificate, can my husband adopt her?

Quite often, yes, but it really depends on your location and the father's consent.

Is the father the acknowledged father - DNA, Court recognized, something else depending on where you are.

In the US if you know the identity of the father he must consent.

It is great that the child has a man who wants to be the father.

In most cases the bio father will have to give his permission. Since he isnot listed, and if he has not been proven the father in court, it will be harder since he may have to be proven the father to sign over his rights for the adoptoin

Her father has been proven through court. He put himself of child support a little after she was born and has failed to make a single payment. Now I am married and my husband has been there for her since she was one. He wants to legally adopt her and have her last name changed to ours. My question is that since her father went through the court system will the adoption be possible? And does the adoptoin release him of his fatherly duties? (those of which he has NEVER done)

Yes, he needs to sign a consent. If he does sign and the adoption is approved by the Court her bio father is no longer her legal father and he no longer has any responsibility for her.

You might offer to forgive all past due support if he signs.

As long as the bio father agree, the adoption is easy. If the bio father doesn't agree, it may still be possible, but will require a court battle.
