My daughters fathers name is not on the birth certificate, can my husband adopt her?

Now I am married and my husband has been there for her since she was one. He wants to legally adopt her and have her last name changed to ours. My question is that since her father went through the court system will the adoption be possible? And does the adoptoin release him of his fatherly duties? (those of which he has NEVER done)
