Johnny graduated a year ago. He is going to the local Junior College. On Friday he went to the school on his lunch break and saw a few of the high school senior out in the parking lot. He suggested that he meet them after school and he would drive them to the big party down by the river. Johnny decided he is going to start drinking early, and he has his cousin buy some beer at the store. So after school students hopped in the front seat of his vehicle and four others jumped in the back. Johnny is racing down the back roads, and the passengers are distracting him. Johnny hit the pot pole and loses control of the car. He goes into the ditch and hits a tree. All six passengers die in the crash. Johnny is charged with six counts of man slaughter. The judge can give him seven years/person. That is forty-two years in jail.

Do you want your questions to be based on the law, or feeling? If it's the law, you'll need to provide more info, such as location, as laws vary by State, Province, country, etc.

Your question is a bit vague. Pretend we're the judge? Well, dear, if I were a judge a lot of people would be in jail that sadly, the law protects. So, do you want a legal answer, or a personal answer?

If I were the judge, Johnny would get life. He was drinking and driving, he wasn't in control of the vehicle, he broke the law (where I live) by putting people in the back cab of the truck. All in all, he was responsible for the people in the vehicle, and distracted or not, he wasn't behaving responsibly. His actions cause their death.

It is a bit odd that everyone but Johnny, died in the crash.

Is this fiction, or nonfiction? What's the point of this question? If you want a legal answer, you haven't given nearly enough information.

I typed everything that was on the paper that was handed out to me and everyone else from Driver's Ed.
I agree with you, there's not a lot of information but the paper is due tomorrow. I'll go with the legal answer please.

We can't give you the legal answer without more detail. Laws vary by State. Do you want us to guess the state? I'm not even in the states, so my answer would be based on the law in Canada, which is very different. For instance, in most states the drinking age is 21. In the province I live in it's 18.

We can't answer this question without more info, and since it's homework, we can't answer it due to the site rules.

I understand that, but I don't see how anyone will be able to help based on what you posted. I get that this is the question you got, but there's not enough information to give a legal answer.

You're posting on a worldwide site. The law isn't the same worldwide, it's not even the same State to State, Province to Province. So really, unless we post the legal answer for every single State, every single Province, every single part of the world, and you choose which best suits you, there's no way to answer this. Frankly, there's no one that's going to put in the effort to do what I just stated.

Seriously, withouit the sentencing statute, the question cannot be answered accurately. Just asking for an opinion is pointless nonsense.

I say he should be tarred and feathered (because I've always wanted to tar and feather someone) then he should be made to shovel snow in Canada for 10 years, and clean my house every day for the next 15 years. Is he a good cook?

Seriously though, the way I'd answer this question, if it's law homework, is to say that there's not enough information to give an answer based on the law. But, if the teacher is looking for your opinion, then state your opinion. You don't need the law for an opinion.

If this is for Drivers Ed why is it titled "law homework" question, plus you're 14. You aren't even eligible for driver's ed in IL.
