View Full Version : Can I get jail time for not being able to pay restitution in the state of Michigan

My husband has five months left of his probation and has medical problems and he can't get hired anywhere because he is too high of a liability... now his probation officer told him that he has to face the judge for review or non payment... he gets ssd and that is all the income for the household... He has been on probation for five years and no violations in Michigan or any other state... is he likely to go to jail for this or can they set up a direct deposit so that each month they can take out a certain amount each month?

It is unlikely that he can set up direct deposit. Why does he not simply make the payments out of the SSD income every month?

Type a 1 page list of income and expenses to take to the hearing (yours too). Bring copies of as much proof as you can. They may want to hear or see it, they may not.
They may take some of his SSD, they may not.
We don't even know his crime or what your finances are. There are many factors that go into this decision.
