My son was driving my truck on a Saturday morning. He got on the ramp and entered the interstate, a lady in a van said he hit her. He said he did not hit her, but he was arrested anyhow. His charges were for driving on a suspended license. Now her insurance company is trying to sue me. If it was a hit and run, shouldn't his charges have been for that? It doesn't make any sense. There were 2 different police reports made with totally two different times for when this accident supposedly took place. I believe my son. What should I do?

Do you have auto insurance? Did he have your permission to use this vehicle?

This one should be easy, is there damage to the vehicle ? Is there new scratches, dents or some sign the accident happened.

But no he was given a ticket for what they can prove and know, I would also worry about insurance company dropping you for allowing a non licensed driver drive.

But let your insurance company handle it, yes they may sue you, tell them to sue, they have to, do that to get money if your insurance company will no settle.

You do nothing let insurance company handle it. I would refuse to even talk to them at this point, let insurance do all of it

The fact that there are conflicting police reports can help you if it comes to court.

But the fact that the other driver was able to identify your vehicle and that's how they traced your son, indicates he was there at the time. Its possible he clipped her without even knowing it. The amount of damage should help with the hit and run charge.

By the way, these are separate things. The Hit and run is a criminal charge, the driving with a suspended license may also be criminal or a traffic violation. The damages to the other driver are a civil matter.

By the way, did you know his license was suspended?
