I recently found out that my husband was not the father of a child from a previuos marriage. The child is now 11 years old and the mother is asking for child support. Can he NOT pay child support? :rolleyes:

Hello my:

If he's NOT the father, then he doesn't have to support somebody else's kid. Of course, paternity can be proven today, rather easily. If he's not the dad, then he might have to prove it. If the mother has an attorney, then hubby needs an attorney.

Actually it may well depend on where you are at, in several US states, if the husband or man who is listed on the birth certificate does not contest the fact he is the father, and is listed without contesting over a number of years. They are always considered the father by law. And will have to continue to pay child support.

Really not fair, but it is the law in seveal places.

So he needs an attorney and make motion with the court where the child support order is coming from to stop the payment.

He will have to continue to pay until the court order is lifted.
