View Full Version : Applying for L1 after h1b cancelled at POE

Hi,

I had Travelled to US on H1b in 2010. Later when I was traveling again, my visa is cancelled at Seattle POE and I was sent back home stating that you don't have LCA which my employer did not gave to me.

I was told that we are not imposing any Ban on you and just go back and reapply the visa as its employer fault. Then I tired for B1 visa twice and was rejected , when I mention the above things in DS-160 form. Now my company is applying for L1A visa and I am worried on same. Did I tell in forms now that my h1b got rejected and sent back from POE as it will again affect L1 processing.

You can't say you don't have LCA because your employer did not give it to you. You're supposed to receive all required documents, unless this recruitment was a phony one.

Please help me as I am in the same situation. I had a valid H1b but it was cancelled at Chicago POE on January 30th 2013 and I was sent back on the same flight as I came in. Later I applied for a B1 nad that was denied at the Chennai Consulate. Now I have found a full time job and my employer is ready to do a new H1 petiton, If I go to the condualte to get it stamped, what are the chances it might be denied? Did you go to the US again? If so how?
If you could email me back I will appreciate your help for a very long time.

You're denied because of fraud. There are a lot of companies involved especially from India. If you have to pay $$ to get selected, then you may be denied again.
